Terms of Service
Short version: the venues are real places we do not control, so check before you rely on them; walk safely and call 911 yourself if you need to; purchases and refunds go through Apple; your memories are yours. The long version is below, and it is the one that counts.
1. The agreement
These Terms are a contract between you and BLACK LAYERS CORP. ("Black Layers", "we"), an Alberta corporation, for the use of the SideQuest iPhone app ("the App"). You accept them by installing or using the App. The Privacy Policy, linked at the bottom of this page, is part of these Terms. These Terms apply in addition to Apple's Licensed Application End User Licence Agreement. Where the two conflict on a matter Apple governs, Apple's terms prevail. This agreement is between you and Black Layers only; Apple is not responsible for the App or its content, and Apple and its subsidiaries are third-party beneficiaries of these Terms. Nothing in these Terms takes away rights you have under the consumer protection law of the province where you live.
2. What SideQuest is, and is not
SideQuest gives two people a short, curated outing: you choose a duration, a budget for two and a mood, and the App reveals a three-stop walk in Calgary one stop at a time, with clues and a suggested route between stops. You can write private memories at each stop and invite one partner to follow the same adventure on their own phone. SideQuest is not: • A booking service. It does not reserve tables, tickets or anything else, and it does not hold money for a venue. • A guide or an agent of any venue. The places in an adventure are independent third parties we do not control. • A navigation or safety app. The route is a suggestion. Use your judgment, your eyes and, if you need one, a proper maps app. • An emergency service. If you need help, call 911.
3. Who may use it
SideQuest is recommended for adults, 18 and older. You must be able to enter a contract, and you must use the App only where it is lawful to do so. Adventures involve walking in public places and visiting venues that may serve alcohol or have their own age or entry rules; you are responsible for meeting those rules. You are responsible for everything done with your account and on your phone.
4. Guest mode and accounts
You can use SideQuest without an account. In guest mode everything you write stays on your phone; if you delete the App, it is gone. If you sign in with Apple, your memories and progress sync to our servers so you can keep them across devices. One person, one account. Do not share your Apple ID. You can delete your account at any time from Settings › Account › Delete; the Privacy Policy explains what is removed and when.
5. Adventures and venue accuracy
We curate each adventure with care, but the venues are third parties. Opening hours, prices, menus, accessibility and even the existence of a place change without telling us. The prices and budgets shown in the App are estimates for two people, not quotes, and do not include tips or tax unless stated. Before you rely on a stop, verify it. If a stop is closed or wrong, use Skip or the backup stop in the App, and tell us so we can fix it. We do not guarantee that any stop will be open, affordable, accessible or as described, and we are not responsible for what a venue does or charges.
6. Safety
You are walking in a real city. Watch for traffic, weather, ice and your surroundings. Do not read your phone while crossing a street. Stop if you or your partner feel unwell or unsafe, and leave any place that does not feel right. The App will not judge you for not finishing. SideQuest cannot contact emergency services on your behalf. If you are in danger, call 911 first and use the App second.
7. Walking with a partner
The host creates an eight-character invite code in the App and gives it to one partner. The code works once and expires after 24 hours. Give it only to the person you want on the adventure. A partner who redeems the code sees the adventure name, the current stop, the clues and the host's display name, and nothing else. The host controls shared progress; the partner can leave at any time. Partner access is for that adventure only. It does not transfer a purchase, an account or any other right, and it is not Apple Family Sharing.
8. Memories and your content
Memories, and any photo you attach, are yours. They are private: not shared with a partner, not shown to Black Layers, not used to train anything, and not used for advertising. You give us only the right to store them on your behalf when you are signed in, so that the App can show them back to you and sync them between your devices. Attach only photos you have the right to use. Do not store anything unlawful in the App. If you delete a memory, it is removed from your device and, when signed in, from our servers.
9. Purchases
Your first adventure is free. Additional single adventures (CA$6.99) and the Calgary City Pass (CA$24.99) are one-time, non-consumable in-app purchases sold through Apple's App Store. Prices are displayed by Apple in your local currency and may differ from the Canadian prices stated here. A purchase is tied to your Apple ID and can be restored on another device with Restore Purchases in the App. It unlocks the stated content only. We receive from Apple the transaction and product identifiers needed to unlock the purchase, and nothing else. We may add, retire or reprice adventures; a purchase you have already made stays unlocked.
10. Refunds
Payments are processed by Apple, and refunds are handled by Apple, not by us. To ask for a refund, use reportaproblem.apple.com. We cannot issue a refund and Apple's decision is final. If Apple refunds or revokes a purchase, the App will lock the related content; your memories are not deleted.
11. Acceptable use
You agree not to: • Use the App to break any law, trespass, or interfere with a venue or its customers. • Share an invite code publicly, or use a code you were not given. • Copy, republish or resell adventure content, clues or routes. • Reverse engineer, decompile or tamper with the App, or try to get around purchase checks, security rules or App Check. • Interfere with our servers or place unreasonable load on them. Breaking these is grounds for ending your access under section 14.
12. Intellectual property
The App, its adventures, clues, routes, illustrations, name and marks belong to Black Layers. Venue names belong to their owners and are used to identify them. You may use the App on your own iPhone for its intended purpose and nothing else.
13. Warranty and liability
The App is provided as it is. We do not promise that a venue will be open, that a route will be safe or accurate, that the App will be uninterrupted, or that a partner link will always connect. To the fullest extent the law allows, Black Layers is not liable for anything that happens at a venue or on a route, for a venue's conduct or charges, or for indirect, consequential or punitive loss. Where liability cannot be excluded, it is limited to the amount you paid us through the App in the twelve months before the claim. Nothing in this section limits liability for death, personal injury caused by our negligence, fraud, or anything else the law does not allow to be limited, and nothing in it limits your rights under provincial consumer protection law.
14. Ending the agreement
You can stop using the App at any time by deleting it, and you can delete your account in the App; the Privacy Policy explains what is removed. We may end the agreement and close your account if you break these Terms, or if we stop offering SideQuest, with notice in the App. Ending the agreement does not refund a purchase; refunds are Apple's to decide under section 10.
15. Governing law and language
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there, and disputes go to the courts of Alberta, except that if you live in another province you keep the protections and forum that your province's consumer law gives you. These Terms are currently in English. A French version is being prepared. If you require the French version before accepting, write to info@blacklayers.ca.
16. Changes
We may change these Terms. When we do, the version and effective date at the top change and the change is announced in the App. If a change materially affects your rights, the App will ask you to accept the new version before you continue. Changes never apply to an adventure already in progress.
